Terms for Australian Players

These terms apply to players who live in Australia. They form part of our Terms of Use. If anything in the Terms of Use conflicts with these terms, these terms apply for players in Australia.
1. Who can play
You must be 21 or older and live in Australia (any state or territory). By using the site, and again when you create an account, you confirm both. Australia classifies games of this style R 18+; we set our minimum age higher, at 21, for every player. We may suspend or close an account if we reasonably believe it does not meet these requirements.
2. Free to play — no money, no prizes
- Everything on the site is free. There is no store and we do not accept payments of any kind.
- Virtual credits have no monetary value. They cannot be bought, sold, transferred, exchanged, cashed out or redeemed for money, goods or services.
- We offer no prizes and do not run competitions, promotions or prize draws. Leaderboard places are for bragging rights only.
- Doing well in free play says nothing about how you would go in any game involving real money.
3. Your rights under the Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in our Terms of Use or these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, that the Australian Consumer Law or any other law gives you and that cannot lawfully be excluded or limited. Any limitation of liability in our Terms of Use applies only to the extent the law allows. In particular, the disclaimer of warranties and the clause on changes to the Terms in our Terms of Use do not apply to you to the extent they are inconsistent with the Australian Consumer Law. We will email registered players about any material change to the terms before it takes effect.
We do not intend any of our terms to be unfair. If a term would be unfair under the Australian Consumer Law, it will not apply to you to that extent.
4. Your account
Your account is free and you can close it at any time by emailing hello@emberplaysocial.com. We will delete your account details within 30 days of your request (keeping only the record of your age and residence confirmation, for up to three years), as explained in our Australian Privacy Notice.
5. Emails from us
We only email you about your account or in reply to your messages. We do not send marketing emails without your consent, and any we send would include an unsubscribe option.
6. Governing law
Our Terms of Use are governed by the law of the country where the operator is established. That does not take away any protection you have under the Australian Consumer Law or the laws of your state or territory that cannot be excluded.
