Terms of Use

These Terms of Use (the "Terms") govern your use of emberplaysocial.com (the "Site"), operated by Emberplay Social ("we", "us"). By using the Site you agree to these Terms; if you do not agree, please do not use the Site.

1. Eligibility — Adults 21+, Canada, Germany & Australia Only

The Site is strictly for individuals who are aged 21 or over and who reside in Canada, in Germany or in Australia. Residents of the Canadian provinces of Quebec and Ontario are excluded and are not permitted to use the Site. By using the Site, and again when creating an account, you confirm that you are at least 21 years old and that you reside in Canada (outside Quebec and Ontario), in Germany or in Australia. We may suspend or remove any account we reasonably believe does not meet these requirements.

2. Free-to-Play Entertainment Only

The Site is a social gaming platform provided solely for entertainment. For the avoidance of all doubt:

  • All gameplay uses virtual credits with no monetary value.
  • Virtual credits cannot be purchased — the Site accepts no payments of any kind.
  • Virtual credits cannot be transferred, sold, exchanged or redeemed for money, goods, services or anything of value.
  • No prizes, winnings or rewards of any value are offered. Leaderboard positions confer bragging rights only.
  • No real money is ever involved. Nothing can be deposited, won, lost or redeemed on the Site, and success at free play does not imply future success at any game involving real money.

3. Accounts

You are responsible for keeping your login details confidential and for activity under your account. Provide accurate information, keep it up to date, and choose a display name that is not offensive, misleading or infringing. You may close your account at any time by contacting us.

4. Acceptable Use

You agree not to: use the Site if under 21; attempt to exploit, disrupt, reverse-engineer or gain unauthorised access to the Site or games; use bots or automation; harass other members; scrape or republish Site content; or use the Site for any unlawful purpose. We may suspend or terminate access for breach of these Terms.

5. Games and Third-Party Content

Games are provided by third-party studios in free-play mode and stream from their servers. Availability of any particular title is not guaranteed and the library may change at any time. Game content is the intellectual property of its respective owners.

6. Our Content

The Site's design, text, graphics and branding are owned by or licensed to Emberplay Social. You may use the Site for personal, non-commercial entertainment; no other rights are granted.

7. Disclaimers

The Site is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and uninterrupted availability. Virtual credits and leaderboard data may be reset, adjusted or removed at any time without liability — remember, they have no value.

8. Limitation of Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and where mandatory law (such as product liability law) so provides. For slight negligence we are liable only for breach of essential contractual obligations, limited to typical, foreseeable damage. Otherwise, to the extent permitted by law, liability for slight negligence is excluded. Because virtual credits have no monetary value, their loss or reset does not constitute damage. Nothing in these Terms limits rights you have under mandatory consumer protection law where you live.

9. Responsible Play

We encourage balanced play. Please review our Responsible Play page, which includes links to free, independent support organisations.

10. Changes

We may update these Terms from time to time. The current version will always be posted here with its "last updated" date, and continued use of the Site after changes constitutes acceptance.

11. General

If any provision of these Terms is found unenforceable, the rest remain in effect. These Terms are governed by the law of the country where the operator is established, without prejudice to mandatory consumer protections of the country where you live. We are neither willing nor obliged to take part in dispute resolution before a consumer arbitration board. Operator details: Imprint.
